Montrose Again: California Adopts Vertical Exhaustion Theory of Access to Upper Level Excess Insurance Policies

In the latest iteration of the Montrose Chemical v. Superior Court[1] litigation, the California Supreme Court unanimously adopted the “vertical exhaustion” rule allowing policyholders to tap excess policies after having exhausted the underlying excess policies with lower attachment points in the same policy period.

President’s Message: June 1, 2020

This has been no ordinary week. As we all absorb and seek ways to meaningfully respond to the tragic events in Minnesota, and occurring across the nation and here in San Diego County, I am compelled to express my personal shock and sadness. Racism and xenophobia continue to perpetuate the vastly unjust treatment and disrespect of people of color in our country. This directly goes against the SDCBA’s core values of Community and Inclusion, which are close to my heart. As a society, we not only can do better. We must be better.

On February 11, 2020 the State Bar Court of California Review Department in the Matter of Gregory Melvin Haynes upheld the State Bar Hearing Judge's finding that misconduct committed by attorney Haynes found by the federal court to require his disbarment from practicing before the Northern District.
